While South Dakota is still stalled when it comes to making legal cannabis a reality within state borders, the state is already working on legislation that allows banks to decide whether or not to do business with the legal cannabis and hemp industry.  While this could allow for an avenue to legal cannabis banking, if all or most banks choose not to work with cannabis, the future industry could be in real trouble. South Dakota Gov. Kristi Noem announced on Wednesday that she is seeking to delay the implementation of a successful voter initiative to legalize medical marijuana. The state’s voters approved Initiated Measure 26 (IM 26) to allow qualified patients to use cannabis medicinally in the November general election with nearly 70% of votes cast. Under South Dakota law, initiatives and amendments are supposed to go into effect on July 1 of the year following passage. A South Dakota judge ruled on Monday that a cannabis legalization initiative approved by voters in the November election is in violation of the state’s constitution and therefore invalid. Judge Christina Klinger of South Dakota’s Sixth Circuit Court ruled that Constitutional Amendment A violates the state constitution on two counts and should not be implemented. Amendment A was approved by 54% of South Dakota voters in last year’s general election. Successful Cannabis Initiatives In Three States Face Legal Challenges

Prohibitionist forces in three states have filed lawsuits to block cannabis legalization initiatives that were approved by voters in this month’s election. Legalization measures appeared on the general election ballots in five states this year, and all were approved by a majority of voters. In Montana, 57% of voters approved Initiative 190, a measure to legalize recreational marijuana in the state. Attorneys for the group Wrong for Montana, which campaigned against the initiative, filed a suit claiming that the measure is unconstitutional because it allocates money from recreational cannabis taxes for specific purposes. South Dakota: Opposition Group’s Polling Shows Voter Support for Marijuana Legalization Initiatives

Statewide polling data commissioned by a marijuana opposition group shows voter support for a pair of 2020 cannabis legalization ballot measures. According to the survey results, some 70 percent of respondents back Initiative Measure 26 — which establishes a medical cannabis access program in South Dakota — and some 60 percent of voters support Constitutional Amendment A, which legalizes the adult-use marijuana market. On November 3rd, voters in the Mount Rushmore State will be presented with two major cannabis reform initiatives.
