An emergency medical technician with the New York Fire Department is ready to take the city to court over a dispute centered around his medical marijuana prescription, according to a story published Monday in the New York Daily News. The report details the case of 26-year-old Benjamin Lerich, who “says the Fire Department has threatened his career if he insists on using pot prescribed to him to treat Crohn’s disease.” Lerich would like to use cannabis to treat his Crohn’s disease, with the Daily News saying that he “wants to use the weed only when going to bed to help […]

New York Cannabis Companies Sidestep Flower Ban With Ground Flower Refills

Flower is forbidden in New York, even for patients in the state’s medical cannabis program. Except that it isn’t. Flower is legally available to New Yorkers with medical cards, so long as it’s ground up, ostensibly for vaping. But a bowl or a blunt will work just as well. When New York started its medical program in 2014, Gov. Andrew Cuomo declared that smoking is bad for you. New Yorkers with medical marijuana cards are allowed to vape and to take tinctures, capsules, and chewables, but the Department of Health does not allow unprocessed flower.  “Smoking medical marijuana is prohibited […]

New York Governor Rolls Out 30-Day Cannabis Amendments

Governor of New York Andrew Cuomo just announced some new, 30-day amendments to his proposal to establish a legal cannabis industry in the state of New York.  His amendments break down how the $100 Million in Social Equity funding will be allocated, as well as how to establish delivery services, and what the breakdown of criminal charges will look like. It also outlines how the newly legal industry will deal with the impacts to those disproportionately affected by the war on drugs.  “As we work to reimagine, rebuild, and reopen New York, we’re taking every opportunity to address and correct […]

Cannabis Expected to Finally be Legalized in New York in 2021

New York Gov. Andrew Cuomo’s efforts to legalize cannabis in the Empire State might finally come to fruition in 2021. Although lawmakers have pushed back on Cuomo’s plans for legalization for the past two years in the major US market, at a recent briefing the governor says he believes 2021 is the year it all changes.  “This is a year where we need the funding, and a lot of New Yorkers are struggling, and I think this year will give us momentum to get us over the goal line,” Cuomo said at a recent briefing. “This should have been passed […]

Governor of New York Announces Proposal To Legalize Adult-Use Cannabis

Will 2021 finally be the year that New York embraces marijuana legalization? Wednesday’s announcement from the state’s governor, Andrew Cuomo, qualified as an encouraging development—though New Yorkers probably shouldn’t start dreaming of dispensaries in the East Village just yet.  In a statement, the Democratic stalwart said he is prepared to unveil “a proposal to legalize cannabis and create an equitable adult-use cannabis program in [New York state],” a program he said would “generate much-needed revenue, while allowing us to support those that have been most harmed by decades of failed cannabis prohibition.”  Cuomo will further detail the proposal in the […]

Saint Regis Mohawk Tribe and Cannabis Company Form Partnership

MMJ BioPharma Cultivation just joined forces with the Saint Regis Mohawk Tribe to develop 20 acres of tribal land into a cannabis grow. The land is in upstate New York near the border of Canada.  The partnership was MMJ’s idea, and tribal officials agreed to the plan, as the land was previously set to become a business park. “The project isn’t a typical medical or recreational marijuana deal where cannabis is grown and sold in the commercial market,” members of the Tewáthahón:ni Corporation Board of Managers say in an official statement.  Because this grow will happen on tribal land, they […]

JUDGE: NEW YORK – PAY VAPING BUSINESS LITIGATION COSTS

There has been a string of good vaping news over the last few weeks.   Nothing that I would considering earth shattering, but wins none the less.   This particular win is with the state of NY.  A Judge has ordered that New York must  pay for the attorney costs of the plaintiffs. This article is still biased against the vaping industry but I will take good rulings from any news source.    The selective abuse vaping has taken (i.e. cant sell menthol vapes, but you can sell menthol cigarettes in many states) is further complicated with the […]
